This Terms of Service Agreement ("Agreement") is a legal contract between you ("User" or "Subscriber") and Century Ventures Capital Sdn Bhd (operating as "360connect"). By accessing or using our services, you agree to be bound by these terms.

⚠️ CRITICAL DISCLAIMER: WHATSAPP BANS

360connect is a technical tool. We have NO CONTROL over WhatsApp's (Meta) internal anti-spam algorithms.

We assume NO LIABILITY if your WhatsApp number is blocked, banned, or suspended.
No refunds will be issued for subscriptions if your account is banned due to your messaging activities.
You are solely responsible for adhering to WhatsApp's Business & Commerce Policies.

1. Acceptable Use Policy

You agree NOT to use the Platform to:

Send unsolicited SPAM or bulk messages without recipient consent.
Promote illegal activities, including but not limited to: Online Gambling, Scams/Phishing, Illegal Drugs, or Pornography.
Distribute malware, viruses, or harmful code via the Form Builder or Campaigns.

Violation of this policy will result in immediate account termination without refund.

2. Service Availability & Third-Party Dependency

The Service depends on third-party platforms (e.g., WhatsApp/Meta APIs). Century Ventures Capital Sdn Bhd cannot guarantee 100% uptime.

We are not responsible for functionality disruptions caused by changes to WhatsApp's API, policies, or infrastructure.
We are not liable for data loss due to server outages or network failures.

3. Fees, Payments & Refunds

Subscription: Services are billed on a subscription basis (Monthly/Yearly).
No Refunds: All payments are final and non-refundable, including in cases of account suspension due to policy violations (e.g., WhatsApp bans).
Price Changes: We reserve the right to modify pricing with 30 days notice.

4. Intellectual Property & Data Ownership

Your Data: You retain full ownership of the customer lists (Contacts) and content you upload. We claim no ownership over your data.
Our System: All rights, title, and interest in the 360connect platform, including software, code, and trademarks, remain the exclusive property of Century Ventures Capital Sdn Bhd.

5. Limitation of Liability

To the maximum extent permitted by Malaysian law, Century Ventures Capital Sdn Bhd shall not be liable for any indirect, incidental, or consequential damages (including lost profits or lost business opportunities) arising from your use of the service.

6. Indemnification

You agree to indemnify and hold Century Ventures Capital Sdn Bhd harmless from any claims, legal fees, or damages arising from:

Your violation of these Terms or the PDPA.
Any third-party claims resulting from the content of your messages (e.g., defamation, copyright infringement).

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
